Permanent and Total Disability Benefits
If the employee is found incapable of returning to any form of gainful employment and the disability is found to be permanent, benefits can continue beyond the maximums provided for temporary total or partial disability and they can conceivably last for the employee's lifetime. Permanent and total disability is payable at 66.66 percent of the average weekly wage up to the maximum weekly rate allowed. Cost of living adjustments (COLA) will also be payable in addition to 34A benefits for injured workers over the age of 65 in all cases. For those under the age of 65, cost of living adjustments may be payable in certain cases.
